The terms governing your use of this website and your dealings with Heritage Hill Builders.

These Terms and Conditions (“Terms”) govern your access to and use of the website at hertiagehillbeuildersdemo.online and any enquiry, quote request or consultation booking you submit through it. The site is operated by Heritage Hill Builders (“Heritage Hill Builders”, “we”, “us” or “our”), a residential construction business based at 20 Savanna Common NE, Calgary, Alberta T3J 0V9, Canada.

By using this website you agree to these Terms. If you do not agree with them, please do not use the site.

1. Who may use this site

You must be at least 18 years old and legally capable of entering into a binding contract to submit any form on this site. By submitting a form you confirm that the information you provide is accurate and that you are either the owner of the property described or authorised by the owner to enquire about work on it.

2. Communications consent

Where a form on this site collects a telephone number, it also presents a separate, unticked consent checkbox that you must tick yourself. By ticking it, you expressly consent to Heritage Hill Builders contacting you by telephone call, SMS text message and email regarding the enquiry you submitted.

  • Consent is not a condition of purchase. You are not required to agree to calls, texts or marketing emails in order to obtain a quote or to purchase any goods or services from us.
  • Opting out. Reply STOP to any text message to stop texts, or HELP for assistance. Every commercial email includes a working unsubscribe link. You may also contact us directly at any time to withdraw consent.
  • Rates. Standard message and data rates from your mobile carrier may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages.
  • These arrangements are made under Canada’s Anti-Spam Legislation (CASL) and are described further in our Privacy Policy.

3. Estimates, quotes and pricing — nothing on this site is an offer

This is important, so it is stated plainly:

  • Nothing on this website constitutes an offer, a quotation, a fixed price, a guaranteed completion date, or a binding commitment of any kind. All descriptions of services, processes, timelines and inclusions are general marketing information only.
  • Any figure, range, timeline or scope discussed verbally, by phone, by text, by email, or at a site consultation is a preliminary indication only and is not binding on either party.
  • Heritage Hill Builders is only bound by a written quotation or contract that has been signed by both parties. Only that signed document governs price, scope, allowances, exclusions, schedule, payment terms and warranty.
  • Where the signed contract states an amount as an allowance, that amount is a budget placeholder for a selection not yet made, and the final price will be adjusted up or down against the actual selection.
  • Written quotations are open for acceptance for the period stated on them, and if no period is stated, for 30 days. After that, pricing may change because of material costs, labour availability, permit requirements or site conditions.
  • Prices in a written quotation exclude GST unless expressly stated otherwise.

4. Site conditions, permits and changes

Residential construction and renovation regularly uncovers conditions that could not reasonably be known beforehand — concealed structural issues, non-compliant existing work, soil or drainage conditions, asbestos or other hazardous materials, or utility locations. Where such a condition is found, we will inform you, explain the options, and price the change in writing before proceeding. Change orders take effect only when agreed in writing.

Where a project requires a development permit, building permit, engineering, or a municipal inspection, timelines depend on the relevant authority and are outside our control. Schedules in a written quotation are good-faith estimates based on normal permit turnaround and normal weather, and are not guarantees.

5. Your responsibilities

If you engage us, you agree to provide safe and reasonable access to the property, to disclose any known defects, hazards, easements or restrictive covenants affecting the site, to obtain any condominium board, homeowners’ association or landlord approvals that apply, to make selections within the timeframes set out in the contract, and to make payments as scheduled. Delay in any of these may affect the schedule and the price.

6. Website content and intellectual property

All content on this site — text, layout, design, graphics, photographs, illustrations, logos and code — is owned by Heritage Hill Builders or used under licence, and is protected by Canadian and international copyright and trade-mark law. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of this site without our prior written permission. The Heritage Hill Builders name and logo are our trade-marks and may not be used without written permission.

Some images on this site are representative imagery used to illustrate the standard and style of work we undertake, and are not necessarily photographs of specific completed Heritage Hill Builders projects. They are illustrative and are not a representation about any particular past project.

7. Accuracy and availability

We take reasonable care to keep this site accurate and current, but we do not warrant that it is complete, error-free or up to date, and we may change or remove content at any time without notice. We do not warrant that the site will be uninterrupted, secure or free from viruses or other harmful components.

8. Disclaimer of warranties

Except as expressly set out in a signed written contract between you and Heritage Hill Builders, and except for any warranty, condition or guarantee that cannot be excluded under applicable law (including the Consumer Protection Act (Alberta) and the New Home Buyer Protection Act (Alberta) where those statutes apply), this website and its content are provided on an “as is” and “as available” basis without warranties or conditions of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing on this website constitutes legal, financial, engineering, architectural, tax or investment advice. Information about permits, building code, secondary suite requirements or zoning is general in nature; requirements vary by municipality, by property and over time, and you should confirm them for your specific property before making decisions.

9. Limitation of liability

To the maximum extent permitted by law, Heritage Hill Builders and its directors, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, business, opportunity, anticipated savings, data or goodwill, arising out of or relating to your use of, or inability to use, this website, however caused and on any theory of liability.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to this website is limited to one hundred Canadian dollars (CAD $100). Liability in respect of construction work performed by us is governed exclusively by the signed written contract for that work.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

10. Indemnification

You agree to indemnify and hold harmless Heritage Hill Builders and its directors, officers, employees, contractors and agents from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of this website, your violation of any law, or your infringement of any third party’s rights.

11. Third-party services and links

This site embeds and links to third-party services, including Google Maps. We do not control those services, do not endorse their content, and are not responsible for their availability, accuracy, or privacy and security practices. Your use of them is governed by their own terms.

12. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

13. Governing law and venue

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles. You and Heritage Hill Builders irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Alberta, sitting in the City of Calgary, for any dispute arising out of or relating to these Terms or this website, subject to any dispute-resolution provision contained in a signed construction contract between us, which will take precedence for disputes about that work.

14. Severability and waiver

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision will be severed or read down to the minimum extent necessary, and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of it or of any other provision.

15. Entire agreement and changes

These Terms, together with our Privacy Policy, are the entire agreement between you and Heritage Hill Builders regarding this website, and supersede any prior understanding about it. A signed written construction contract, where one exists, governs the work itself and takes precedence over these Terms in respect of that work.

We may revise these Terms at any time by posting an updated version on this page with a new “Last updated” date. Your continued use of the site after a change takes effect constitutes acceptance of the revised Terms.
