Heritage Hill Builders (“Heritage Hill Builders”, “we”, “us” or “our”) operates the website at hertiagehillbeuildersdemo.online and provides residential construction services in Calgary, Airdrie and Chestermere, Alberta. This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, who we share it with, and the rights you have over it.

We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Alberta’s Personal Information Protection Act (PIPA), and Canada’s Anti-Spam Legislation (CASL). By using this website or submitting a form, you agree to the practices described here.

2.1 Information you give us

When you submit a quote request, contact form, consultation booking request, or download a guide, we collect the information you enter. Depending on the form, this may include:

  • Your name;
  • Your email address;
  • Your telephone number;
  • The address or location of the property you are enquiring about;
  • The type of project, your intended timeline, and any project details, notes or preferences you choose to describe;
  • Your preferred appointment date and time; and
  • Your communications consent selection.

We only ask for information that is reasonably necessary to respond to your enquiry, prepare a quote, or schedule and carry out work. You are not required to provide any of it, but if you do not, we may be unable to quote or schedule your project.

2.2 Information collected automatically

Like most websites, our site and its hosting infrastructure may automatically record technical information such as your IP address, browser type and version, device type, the pages you viewed, the date and time of your visit, and the referring page. Where analytics tools are enabled, they may use cookies or similar technologies to collect aggregate usage statistics. This information is used to keep the site secure, diagnose problems, and understand which content is useful.

2.3 Approximate location

One element of this website may display your approximate city by calling a third-party IP geolocation service directly from your browser. This lookup is performed by your own browser, returns only an approximate city-level location, and is not stored by us.

2.4 Information we do not collect

We do not collect payment card details, banking information, social insurance numbers, or government identification through this website. We do not knowingly collect personal information from anyone under the age of 18.

3. Why we collect it, and your consent

We collect, use and disclose personal information only for purposes a reasonable person would consider appropriate in the circumstances, namely to:

  • Respond to your enquiry and answer your questions;
  • Arrange, confirm, reschedule and attend a site consultation;
  • Prepare, send and discuss a written quote or estimate;
  • Plan, schedule, perform, inspect and warrant construction work;
  • Coordinate with subcontractors, suppliers, designers, engineers and municipal authorities where necessary to carry out your project;
  • Maintain our business records, including records of consent;
  • Comply with legal, regulatory, permit, safety and insurance obligations; and
  • Send you information you have expressly asked for, such as a requested guide.

We rely on your express consent, given when you tick the consent box on a form, for commercial electronic messages and for contact by telephone and text message. We rely on implied consent where you have conspicuously published or directly provided your contact details in relation to an enquiry, as permitted under CASL. We do not use your information for any new purpose without obtaining your consent first.

4. Communications consent — calls, emails and text messages (CASL)

This section describes the basis on which Heritage Hill Builders contacts you, and how you stop it.

  • Express consent. Every form on this site that collects a telephone number includes a separate, unticked consent checkbox. You must tick it yourself before the form will submit. Ticking it means you agree that Heritage Hill Builders may contact you by telephone call, SMS text message and email about the project enquiry you submitted.
  • Consent is not a condition of purchase. You do not have to agree to receive calls, texts or marketing emails in order to obtain a quote or to buy any goods or services from us. If you would rather not tick the box, call us on (587) 437-2793 or email us instead and we will deal with your enquiry that way.
  • Message frequency. Message frequency varies and depends on the stage of your enquiry or project. We do not send bulk marketing text messages.
  • Message and data rates. Standard message and data rates charged by your mobile carrier may apply to any text message you send or receive. Heritage Hill Builders does not charge you for text messages.
  • How to opt out of texts. Reply STOP to any text message from us at any time and you will be unsubscribed from text messages. Reply HELP for assistance, or contact us using the details in section 1.
  • How to opt out of email. Every commercial email we send includes a working unsubscribe mechanism that takes effect no later than 10 business days after you use it, as required by CASL. You may also email us directly to be removed.
  • How to opt out of calls. Tell us on any call, or contact us using the details in section 1, and we will record the request and stop calling.
  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.
  • Records of consent. We keep a record of the consent you gave, including the date and time it was given and the wording you agreed to, for as long as is necessary to demonstrate compliance and for a reasonable period afterwards.

5. Who we share information with

We do not sell your personal information, and we do not rent or trade it. We disclose it only as follows:

  • Service providers. Website hosting, email delivery, customer relationship management, scheduling and analytics providers who process information on our behalf under contract, and only for the purposes we specify.
  • Trades and project partners. Subcontractors, suppliers, designers, engineers and surveyors, where sharing your name, site address and project details is necessary to price or perform your project.
  • Municipal and regulatory authorities. Where required for permit applications, inspections, utility connections or code compliance.
  • Professional advisers and insurers. Where reasonably required in connection with a claim, dispute or legal obligation.
  • Legal requirements. Where we are required or permitted to disclose information by law, by subpoena, by court order, or to protect the rights, property or safety of any person.
  • Business transfer. If our business is sold, merged or reorganised, personal information may be transferred as part of that transaction, subject to equivalent protection.

6. Transfers outside Canada

Some of our service providers store or process information on servers located outside Canada, including in the United States. Where that is the case, your personal information may be subject to the laws of that jurisdiction and accessible to its courts, law enforcement and national security authorities. We use contractual and other measures to require comparable protection. 7. How we protect your information

We use security safeguards appropriate to the sensitivity of the information, including encrypted transmission (HTTPS) for data submitted through this website, access controls limiting who within our organisation can see personal information, and contractual requirements on our service providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we take these obligations seriously and will notify you and the Office of the Privacy Commissioner of Canada of any breach that creates a real risk of significant harm, as required by law.

8. How long we keep it

We keep personal information only as long as necessary for the purposes it was collected for, and to meet legal, tax, warranty, insurance and limitation-period requirements. Enquiries that do not proceed to a project are generally retained for a limited period and then deleted or anonymised. Project records, including records of consent, are kept for longer because of warranty and limitation obligations relating to construction work in Alberta.

9. Your rights

Under PIPEDA and Alberta’s PIPA you have the right to:

  • Access the personal information we hold about you, and be told how it has been used and to whom it has been disclosed;
  • Correct personal information that is inaccurate or incomplete;
  • Withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice — we will tell you the consequences of withdrawal before acting on it;
  • Request deletion of personal information we no longer need for a legal or business purpose;
  • Ask questions or complain about how we handle your information.

To exercise any of these rights, contact our Privacy Officer using the details in section 1. We will respond within 30 days, or tell you within 30 days if we need an extension and why. There is no fee for a reasonable access request.

If you are not satisfied with our response, you may complain to the Office of the Privacy Commissioner of Canada (priv.gc.ca, 1-800-282-1376) or, where Alberta’s PIPA applies, to the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca, 1-888-878-4044).

10. Cookies and tracking

This website may use cookies and similar technologies to remember your preferences and to collect aggregate analytics about how the site is used. Most browsers let you refuse or delete cookies through their settings. Blocking cookies will not prevent you from using this site, though some conveniences may not work. Where advertising or analytics pixels are in use, they are disclosed here and may be disabled through your browser or the relevant provider’s opt-out tools.
